Delhi High Court issues notice to Centre for violating 1984 order on Waqf properties

The Delhi High Court has issued a notice to the Centre regarding 123 properties in the national capital that are being unlawfully claimed as Waqf properties. A previous ruling from 1984 stated that these properties should remain under government ownership. However, in 2014, the Congress government transferred the properties to Waqf, in violation of the court’s order. The court has listed the matter for hearing on July 26. A petition filed earlier this year sought to ensure compliance with the 1984 order, arguing that the transfer of the properties to Waqf violates the rights of the public and the secular nature of the Indian Constitution. The petition also highlighted ongoing losses to the public exchequer and encroachments on the 123 government properties. The petition called for a proper actual survey of the properties to determine the actual owner and evacuate any encroachments.
