Man Acquitted in Drive-By Shooting Death Due to Lack of Evidence

A man charged in a drive-by shooting that resulted in the death of a 61-year-old woman in August 2018 has been found not guilty of first-degree murder by a jury. Moeez Khan Tahirkheli, 23, was arrested and charged in Brenda Herbin’s death after admitting to driving the vehicle believed to be involved. However, defense attorney Don Carter argued that the police failed to properly investigate the case before charging Tahirkheli, and there was no physical evidence linking him to the crime.

The trial, held in Guilford County Superior Court, began on Tuesday and concluded with the jury taking only about 30 minutes to deliver their verdict. In his closing argument, Carter highlighted the lack of physical evidence connecting Tahirkheli to Herbin’s death. The prosecution’s case heavily relied on a video of Tahirkheli’s police interview, along with a bullet found on Franklin Avenue and a gun discovered at a house where another suspect sometimes stayed.

Carter pointed out that the bullet was never examined for fingerprints and the gun did not contain DNA from either of the charged individuals. Moreover, investigators who searched Tahirkheli’s car on the night of the shooting found no gunshot residue or shell casings. Assistant District Attorney Matt Stockdale, on the other hand, emphasized Tahirkheli’s interview with the police, where he expressed his desire to find a Honda Civic he believed was related to a previous shooting incident in Greensboro.

However, Carter argued that Tahirkheli never stated any intention to harm the occupants of the Honda and simply wanted to identify them. Regarding Tahirkheli’s account of the events leading to Herbin’s death, which involved the other charged individual, Xavier Drayton, 23, firing shots at a Honda Civic, Carter contended that Drayton provided a different version of what had occurred.

The acquittal of Moeez Khan Tahirkheli highlights the role of evidence in criminal trials. While the jury found him not guilty, it is essential to consider the impact this verdict has on the victim’s family and the community seeking justice.
