3-Year-Old Malaysian Girl Receives RM5.6 Million Compensation from KL High Court Following Paralysis Caused by C-Section Surgery

In a recent ruling, the Kuala Lumpur High Court has awarded a 3-year-old Malaysian girl RM5.6 million in compensation for medical negligence that resulted in her being paralyzed. The girl, Nur Adeena Mohd Syahmir, was born in May 2020 via a Caesarean section (C-section) procedure. However, the surgery complications led to a spinal cord injury, leaving her paralyzed from the neck down.

According to reports, Nur Adeena’s father filed a medical negligence suit against 19 defendants, including the Malaysian government and 18 medical officers from the government hospital. The first defendant, the Malaysian government, admitted liability on July 26, 2022, leading the plaintiff to withdraw claims against the other defendants.

During the trial, it was revealed that the medical officer on duty had no prior experience in performing surgeries, and the C-section procedure was conducted without the supervision of obstetricians and gynecologists. The court acknowledged that no amount of money could alleviate the pain and suffering experienced by the child. However, it deemed that the awarded damages were necessary to cover the additional expenses incurred by the child’s guardian in caring for her.

The court ruled that Nur Adeena is entitled to adequate compensation for the rest of her life, which may be until the age of 23, as determined by a specialist doctor. The case highlights the devastating consequences that can arise from medical negligence and underscores the importance of ensuring experienced professionals are involved in surgical procedures.
