A man is suing a convicted paedophile and other members of the abuser’s family claiming he was the victim of assault and battery and emotional suffering while in foster care with the family.

Michael Dilger is bringing action against Keith Burke and his parents Kathleen and Gerry as well as the HSE and Tusla. Dilger alleges that he suffered abuse at the hands of the Burke family while under their care.

Keith Burke, who was previously sentenced to 7½ years in prison for the rape of three girls in the same foster home, is at the center of the lawsuit. Dilger accuses the Burke family of assault, battery, and causing emotional distress during his time in their care.

The HSE and Tusla are also named in the legal action, as Dilger claims they failed to properly vet the Burke family before placing him in their care. He contends that they neglected to adequately assess the abusive potential of the Burkes, leading to the harm he suffered.

The legal proceedings involve a request for the disclosure of documents related to the investigation, inspection, and oversight of the Burke foster family by the HSE and Tusla. These documents are seen as pivotal in establishing the responsibility of the agencies in ensuring the safety and well-being of children in foster care.

While the discovery orders have been amended to focus on the social work files of Dilger and the Burke parents, the case continues to shed light on the challenges and failures within the foster care system. The outcome of this lawsuit could set a precedent for accountability and oversight in the placement of vulnerable children in foster homes.

As the legal proceedings unfold, the importance of safeguarding children in foster care and holding accountable those responsible for their well-being remains at the forefront of this case. Dilger’s pursuit of justice serves as a reminder of the need for diligent oversight and thorough assessment in the foster care system to prevent future instances of abuse and neglect.
