Rehfeldt argued that the bill is necessary to protect the health of women and babies and to provide clarity for healthcare providers who may face criminal penalties if they perform an abortion that doesn’t meet the legal standard. Supporters of the bill hope it will gain bipartisan support and provide necessary clarity in the face of confusion caused by the abortion industry. South Dakota’s ban on abortion went into effect after the Supreme Court overturned Roe v. Wade in June 2022, granting states the authority to regulate abortion rights.
