FBI Raid on New Mexico Defense Attorney’s Office Leads to Dismissal of 150+ DWI Cases, US

The office of New Mexico defense attorney Thomas Clear III was raided last week by the FBI. As reported by the Albuquerque Journal, it was part of an ongoing federal investigation into the prosecution of DWI cases. The investigation has had significant repercussions, leading to the dismissal of over 150 DWI cases and putting several police officers on leave.

According to court records, of the 152 pending DWI cases dismissed, 136 were filed by three Albuquerque police officers, accounting for nearly 90% of the total. One of the officers was responsible for 67 cases, another for 41 cases, and the third was listed as the arresting officer in 28 cases. The majority of the dismissed cases were filed in 2023, with 107 cases, which constituted 10% of APD’s DWI misdemeanor cases for the year. Eleven cases had been filed this year.

District Attorney Sam Bregman expressed his displeasure with the dismissals, stating that they felt like a gut punch. However, he acknowledged that prosecutorial ethics require me to dismiss them. The same day, the homes of at least three assistant public defenders were also searched in connection with the same investigation.

APD spokesman Gilbert Gallegos confirmed that several officers have been placed on paid administrative leave while the investigation continues. He stated that the APD had been collaborating with the FBI for several months to investigate members of the department. Currently, no charges have been filed, and no arrests have been made in connection with the ongoing investigation.
