Delhi High Court Restraint Against YouTube Partner in Defamation Case, India

The Delhi High Court has issued a restraining order against Vivek Bindra’s YouTube partner, Vikas Kotnala, prohibiting him from making defamatory allegations and posting disparaging content against renowned motivational speaker Sandeep Maheshwari. Justice Prateek Jalan passed the order in response to a plea filed by Maheshwari, emphasizing the need to prevent the spread of harmful content.

The court’s decision comes in light of a previous order issued by the Faridabad Court on December 22, 2023, which prohibited both Maheshwari and Bindra from posting material that targeted each other. The bench determined that Kotnala’s video constituted a violation of the civil court’s order, particularly considering his connection with Bindra.

Highlighting the severity of the situation, senior advocate Sandeep Sethi, representing Maheshwari, drew attention to two videos shared by Kotnala. In these videos, Kotnala made baseless accusations, claiming that Maheshwari had attempted to extort money from Bindra.

Recognizing the potential irreparable harm to Maheshwari’s reputation, the bench acknowledged that a restraint order was necessary to safeguard his interests. As a result, the court fully supported Maheshwari’s plea and subsequently passed the restraint order.
