Florida Rep. Tyler Sirois Introduces Bill Restricting Social Media Use for Minors

Florida Representative Tyler Sirois has proposed legislation aimed at limiting social media usage among individuals under the age of 16. The bill, known as House Bill 1, has garnered significant attention as a priority for the Republican-controlled Florida Legislature. Sirois, a Republican from Merritt Island, seeks to protect minors from exposure to inappropriate or harmful content often found on social media platforms.

The proposed legislation imposes several requirements on social media platforms operating in Florida. It mandates that these platforms prohibit minors under the age of 16 from creating new accounts and establish a procedure for terminating existing accounts held by such individuals. Additionally, Sirois’ bill would grant parents or legal guardians the authority to request the termination of their child’s social media account.

Furthermore, social media platforms would be required to implement a system to verify the age of each new account-holder. To maintain impartiality, the platforms must use an independent third party not associated with the social media provider. Sirois argued that social media platforms contribute to the rise of bullying, harassment, and other mental health issues among minors, including depression and suicidal thoughts. He emphasized the necessity of taking action to address these concerns.

The bill does not specifically target any particular social media platform. Instead, it defines a social media platform as an online forum provided by an entity that has the ability to monitor the activities of its account-holders. For clarification, the bill outlines the functions that an online forum must include to fall within this definition.

In a bid to address potential objections, the proposed legislation outlines various exceptions to the prohibition on social media usage for those under 16. For instance, online services, websites, or applications that primarily function as email platforms, direct messaging services, streaming services, news and entertainment content providers, online shopping platforms, and gaming websites are exempt. Additionally, exceptions are made for platforms that facilitate photo editing, career development, business-to-business software, teleconferencing, document collaboration, cloud computing, academic research, genealogical research, and classified ad services.

Non-compliance with the stipulated regulations would result in legal action from the Florida Attorney General’s Office, under the violation of the Florida Deceptive and Unfair Trade Practices Act. Furthermore, parents would have the right to initiate legal action if their child were granted a social media account in violation of the law.

To improve transparency and user safety, social media companies allowing individuals under the age of 18 to create accounts must clearly disclose their content moderation policies, whether manipulated photos can be shared on the platform, and whether any personal information about users under 18 is collected or sold. Additionally, these companies must provide information on local resources for law enforcement, suicide prevention, domestic violence prevention services, as well as reporting mechanisms for harmful behaviors like bullying, harassment, and threats of violence or self-harm.

Sirois’ bill has found support from Representative Fiona McFarland, a Republican from Sarasota, who is co-sponsoring the legislation. Additionally, Senator Erin Grall, a Republican from Vero Beach, is anticipated to sponsor the Senate version of the bill.

Notably, Representative Chase Tramont, a Republican from Port Orange, also introduced a bill on Friday that focuses on age verification for accessing certain websites and applications that may contain material harmful to minors. Tramont’s bill, designated as House Bill 3, specifically defines material harmful to minors and outlines the requisite measures for limiting access to such content.

Representative Sirois expressed his willingness to engage with all stakeholders, including social media platforms, to discuss potential modifications to the legislation. However, he stressed the importance of implementing safeguards to protect children when conducting business in Florida.

The legislation aims to establish stringent regulations for social media platforms and ensure the verification of account holders’ age.
