Allahabad High Court Prohibits Arms in UP Court Premises, India

The Allahabad High Court has implemented a ban on carrying weapons within court premises across Uttar Pradesh, except for security personnel. The decision came as a response to a writ petition filed by Barabanki lawyer Amandeep Singh, whose arms license was cancelled after he carried a licensed weapon within the Barabanki court complex.

The court directed district judges and other judicial officers to file First Information Reports (FIRs) against individuals found in violation of the ban and inform the licensing authority to revoke their arms licenses. The court emphasized that carrying firearms in the court premises, including advocate chambers, canteens, and bar associations, poses a threat to public peace and safety.

In dismissing Singh’s petition, Justice Pankaj Bhatia of the Lucknow bench stated, It is a sombre moment in the judicial chronicles when a lawyer, having practiced for a mere two years, harbours the misguided notion that wielding arms within the courtroom is essential for professional success. The court criticized Singh’s belief, stating that it goes against the principles of a fair and just legal system and undermines the integrity and decorum of the judicial process.

The bench further condemned Singh’s perspective, stating that being a lawyer does not require wielding a weapon but rather emphasizes the importance of legal knowledge, hard work, and understanding of the law. They emphasized that the legal profession is a noble one and warned against the impression that success relies on the barrel of a gun.

The ban on weapons in court premises aims to uphold the principles of a fair and secure judicial system. The court’s decision serves as a reminder that the legal profession should prioritize professionalism, integrity, and respect for the law.
