Delhi HC Dismisses NewsClick’s Plea, Citing Reverse Engineering Transaction, India

The Delhi High Court has rejected NewsClick’s plea for a stay on an income tax demand, stating that the news portal has a lot to answer in its appeal before the commissioner of I-T (appeals). Acting chief justice Manmohan and justice Mini Pushkarna declined to provide any relief to NewsClick and highlighted the assessing officer’s findings against the petitioner. The court noted that the transaction between NewsClick and the foreign entity was based on ‘reverse engineering’ and expressed doubt in the petitioner’s claims of financial stringency due to poorly maintained accounts. NewsClick had approached the High Court after the I-T department dismissed its plea for the stay of demand in November 2023 and February 2023. The court’s decision emphasizes the need for NewsClick to address the concerns raised by the assessing officer.
