Colorado Sets an Example with Affordable Fertility Treatment Coverage and Inclusive Definitions

In a groundbreaking move, the state of Colorado is leading the way in offering affordable fertility treatment coverage and inclusive definitions. Thanks to a new law that went into effect in January 2023, large group commercial insurance plans in Colorado are now required to provide coverage for medically necessary fertility preservation treatments. Moreover, the law also broadens the definition of infertility to include the LGBTQ+ community and single individuals, ensuring that everyone has the opportunity to start a family.

For many hopeful parents, the journey to parenthood is not only emotionally challenging but also financially burdensome. Emma Byers and Cam Brennan, a same-sex couple, understand this struggle firsthand. After spending nearly $20,000 out of pocket for intrauterine insemination, they were blessed with twins. However, when they decided to expand their family further, they faced the hurdle of the high cost of in vitro fertilization (IVF). Unfortunately, they were not in a position to afford the approximately $30,000 price tag for a single IVF cycle.

The introduction of the new law in Colorado has been a game-changer for couples like Byers and Brennan. Not only does it ensure coverage for fertility treatments, but it also provides a lifeline to those who otherwise could not afford the cost. According to Dr. Cassandra Roeca, a Denver fertility specialist, there has been a significant increase in the number of patients seeking treatment since the law took effect. She notes that the coverage has shifted from around 30% last year to approximately 70% this year, marking a promising change in access to fertility care.

What makes Colorado’s approach even more groundbreaking is the inclusivity of its definition of infertility. The American Society of Reproductive Medicine recently expanded its definition to encompass single individuals and LGBTQ+ people. This move recognizes that anyone who requires medical intervention to build their family deserves equal access to care. Sean Tipton, the chief advocacy and policy officer at the American Society for Reproductive Medicine, emphasizes the importance of providing the necessary support and care to all individuals in need.

While Colorado has set a precedent in fertility treatment coverage and inclusivity, advocates are putting pressure on large employers to follow suit. Many large employers, who often self-insure, are being called upon to prioritize the reproductive needs of their employees. Currently, only around eight out of the 21 states plus the District of Columbia with fertility insurance laws are inclusive, according to Betsy Campbell, the chief engagement officer at Resolve: National Infertility Association. It is crucial to continue advocating for inclusive coverage nationwide to ensure that all individuals, regardless of their sexual orientation or marital status, have access to fertility treatments.

For the moms in Denver, Emma Byers and Cam Brennan, their family is now complete with the birth of their daughter in May. They consider themselves incredibly fortunate to have had the opportunity to fulfill their dream of having a family, and they hope that others will have the same chance. By taking a step forward in providing affordable fertility treatment coverage and inclusive definitions, Colorado has become a shining example for other states and countries to follow.
