FAA Expected to Extend Restrictions on Safety of Spaceflight Participants

The Federal Aviation Administration’s (FAA) restrictions on the regulation of safety for spaceflight participants are likely to be extended, according to Kelvin Coleman, the head of the FAA’s commercial spaceflight office. Speaking at the AIAA’s ASCEND conference, Coleman stated that the current learning period would be pushed past its expiration date of January 1. The learning period restricts the FAA’s ability to enforce safety regulations on commercial spacecraft carrying passengers.

While industry witnesses in a Senate hearing advocated for another extension of the learning period, there was no consensus on the duration. Bill Gerstenmaier of SpaceX supported the extension, emphasizing the diversity of technical approaches and the need to carefully consider safety regulations. However, not everyone agreed with extending the learning period. Doug Ligor of the Aerospace Corporation argued that a methodical approach to regulation was necessary and that a moratorium was unnecessary.

The learning period’s potential extension has raised concerns regarding the impact on ongoing discussions about the future of safety regulations. Mary Guenther of the Commercial Spaceflight Federation highlighted the importance of productive cooperation and suggested that prematurely ending the learning period could disrupt these discussions. Guenther also praised the FAA’s creation of the space-focused aerospace rulemaking committee (SpARC) to develop regulations for occupant safety.

Coleman echoed Guenther’s sentiments, emphasizing the need for the SpARC to consider transitioning from the current informed consent approach to a more comprehensive regulatory framework. He stressed the urgency of taking advantage of the current low flight rate to establish effective regulations to prevent potential accidents. Gerstenmaier agreed that informed consent was crucial but supported the SpARC in shaping future regulations.

The extension of the learning period has elicited a mix of opinions within the industry, as stakeholders weigh the benefits of continued collaboration and the necessity of regulations. However, all parties agree that safety should remain a top priority, particularly as the commercial space industry continues to grow.
