Supreme Court seeks Centre’s response on release of Rohingya refugees, India

The Supreme Court of India has requested a response from the Centre regarding the release of Rohingya refugees who are allegedly being detained illegally and arbitrarily in various detention centers and jails across the country. The bench, consisting of Justices BR Gavai and PK Mishra, has issued a notice to the Centre and has listed the matter to be heard in four weeks.

The plea seeks to restrain the government from detaining Rohingya refugees without proper accusation of being illegal immigrants or under the Foreigner’s Act. Filed by Priyali Sur, an independent multimedia journalist, the plea argues that the continued detention of Rohingya refugees is not only illegal but also unconstitutional, as it violates fundamental rights guaranteed under Articles 21 and 14 of the Indian Constitution, regardless of their citizenship status.

The petition emphasizes that the Rohingya refugees have fled Myanmar due to a situation that has been acknowledged by the international community, including the United Nations and the International Court of Justice, as genocide and crimes against humanity.
