Delhi High Court Quashes FIR Against Former Air India Pilot Arvind Kathpalia, Citing Insufficient Allegations

The Delhi High Court recently made a significant ruling, quashing an FIR (First Information Report) filed against former Air India pilot Arvind Kathpalia. The court concluded that the allegations made against Kathpalia were insufficient to establish a case against him.

The FIR had accused Kathpalia of violating aircraft rules, including evading a breath analyser test and committing forgery. However, the court found that these allegations were not robust enough to warrant further legal action.

Justice Saurabh Banerjee, presiding over the case, explained that subjecting Kathpalia to double jeopardy for the same offense would be unjust, considering that he had already been cleared of any wrongdoing during the disciplinary proceedings. The court emphasized that continuing with the FIR would force Kathpalia to undergo unnecessary ordeals for the same offense.

Arvind Kathpalia was removed from his position as director of operations of Air India in November 2018 after failing the pre-flight alcohol test. The government cited the seriousness of the transgression and his failure to rectify the behavior as the basis for his removal.

Kathpalia’s counsel, senior advocate Maninder Singh, argued that the Disciplinary Authority of Air India had filed a charge sheet against his client, alleging forgery and misconduct. However, Kathpalia provided a response to the charge sheet, and after reviewing the relevant records, the chairman of Air India found the allegations of forgery as unsubstantiated. Consequently, the disciplinary case against Kathpalia was closed.

Singh further contended that the FIR against Kathpalia should be quashed, given the closure of the disciplinary proceedings.

The prosecution, however, raised objections, asserting that Kathpalia had deliberately flouted regulations and evaded a breath analyser test. They argued that he had the opportunity to undergo the test upon returning from Bengaluru but failed to comply with the protocols.

The high court, in its ruling, acknowledged that disciplinary proceedings and criminal prosecution could occur simultaneously. However, it stressed that when the disciplinary proceedings had conclusively proven innocence, there was no reason for the criminal prosecution to continue.

The court determined that the allegations against Kathpalia were insufficient to justify the continuation of the FIR. Moreover, it believed that continuing with the criminal proceedings would subject Kathpalia to unwarranted injustice. Consequently, the high court quashed the FIR against him.
