Delhi High Court Quashes FIR Against Former Air India Pilot Arvind Kathpalia, Citing Insufficient Allegations

Kathpalia’s counsel, senior advocate Maninder Singh, argued that the Disciplinary Authority of Air India had filed a charge sheet against his client, alleging forgery and misconduct. However, Kathpalia provided a response to the charge sheet, and after reviewing the relevant records, the chairman of Air India found the allegations of forgery as unsubstantiated. Consequently, the disciplinary case against Kathpalia was closed.
Singh further contended that the FIR against Kathpalia should be quashed, given the closure of the disciplinary proceedings.
The prosecution, however, raised objections, asserting that Kathpalia had deliberately flouted regulations and evaded a breath analyser test. They argued that he had the opportunity to undergo the test upon returning from Bengaluru but failed to comply with the protocols.
