ANC MP’s Murder Case Postponed: High Court Decision Awaited
The murder case involving ANC MP Sibusiso Kula has been postponed by the Orkney magistrate’s court until October 23. The court is awaiting a decision from the North West director of public prosecutions (DPP) on whether the case will be transferred to the high court. Kula, 35, is charged with the murder of his wife, Jennifer Motlhomi, who was found dead at their home in Orkney in November 2022. He was arrested in January 2023.
Kula’s lawyer argued against a further postponement, citing unreasonable delay by the state. However, the state indicated that previous delays were due to incomplete investigations. With the investigations now complete, the state is ready to act once they receive instructions from the DPP, according to National Prosecuting Authority spokesperson, Henry Mamothame. During Kula’s court appearance, he was also provided with a list of witnesses.
Currently out on R50,000 bail granted by the North West high court after initially being denied bail by the magistrate’s court, Kula awaits further developments in the case.
The murder of Jennifer Motlhomi shocked the community in Orkney. Initially believed to be a robbery, further investigation led to Kula’s arrest as a suspect. The case has attracted significant attention, and the postponement has further heightened interest in the trial.
While Kula’s lawyer argues against more delays, the completion of the investigations and readiness of the state to proceed may suggest that the trial will move forward soon. The decision of the DPP on transferring the case to the high court will be crucial in determining the course of justice.
As the case awaits a decision from the DPP, the public will be eager to see how the proceedings unfold. The victim’s family and the community at large are hopeful that justice will be served in this tragic incident.
